Oscar’s defence to appeal against State

The legal team for Paralympian Oscar Pistorius have confirmed that they intend to oppose the State’s appeal for a longer prison sentence.

North Gauteng High Court Judge Thokozile Masipa sentenced the athlete to five years behind bars on October 21st having found him guilty of culpable homicide for shooting his model girlfriend, Reeva Steenkamp, at his Silver Lakes estates home on Valentine’s Day last year.

In their appeal report filled on Tuesday, the State maintained that Judge Maspia incorrectly applied the principles of dolus eventualis when she acquitted Pistorius of murder.

State Prosecutor Gerrie Nel had argued during final sentencing, that five years was “shockingly inappropriate” given the nature of the crime, and that an effective 10 years behind bars would have been satisfactory.

The matter is expected to be heard on November 18th.
