Spy Tapes: DA wins court battle to have corruption charges against President Zuma reinstated


The Democratic Alliance’s (DA) seven-year battle to have corruption charges against President Jacob Zuma reinstated, finally paid off on Friday when the Pretoria High Court that, former head of the National Prosecuting Authority (NPA), Mokotedi  Mpshe’s, decision not to charge Zuma was irrational.

Zuma was facing 783 corruption charges before his ascension to power. Those charges were controversially dropped in 2009, allowing Zuma to be elected as the president later that year.

“Today is a great victory for the rule of law, and President Jacob Zuma must face prosecution” said DA leader Mmusi Maimane.

Judge Justice Aubrey Ledwaba said that, Zuma’s lawyers’ were pressurising Mpshe hence he made irrational decisions. And Scorpion boss, Leonard McCarthy had manipulated the timing of when to serve the incrimination against Zuma.

“Mpshe made a half-hearted attempt to hear the other side before he decided to prosecute. Mr Zuma should face all the charges applied”said Ledwaba.

In the judgement, the court distinguished between three decisions which are, decision to prosecute, the decision on when to indict and the decision to continue the prosecution.

President Zuma had not announced whether he will appeal the High Court decision at the time of publishing this article.
