ACDP's Grootboom says they're also bringing criminal charges against Bobani

The African Christian Democratic Party’s (ACDP) sole Councillor in the Nelson Mandela Bay Municipality, Lance Grootboom, on Thursday said his party will also bring criminal charges against Nelson Mandela Bay Municipality Executive Mayor, Mongameli Bobani.

This follows after the Democratic Alliance (DA) also announced that it would bring charges against Bobaniover alleged interference with the awarding of contracts in the Metro.

The DA on Wednesday announced that it has written to Minister for Cooperative Governance and Traditional Affairs (Cogta), Zweli Mkhize, to make a Section 154 intervention in the Nelson Mandela Bay Municipality, after the appointment of Peter Neilson as Acting Municipal Manager.

Like the DA, the Grootboom also announced that his party would bring a motion of no confidence against Bobani at the next Council Meeting in December.

ACDP's Lance Grootboom wants Bobani criminally charged

Grootboom said in a statement that the ACDP are planning to lay criminal charges against Mayor Bobani for political interference in the administration.  

He said that the ACDP is of the view “that Cllr Bobani and his ruling Coalition’s instructions to Acting City Manager Peter Nielson to bring back all suspended staff charged with various charges including corruption and gross dereliction of duties [amounts] to political interference in the administration”.  

Grootboom said that in terms of Section 119 of the Local Government Municipal Systems Act, a Councillor, who attempts to influence the Municipal Manager or any other staff member or an agent of the Municipality not to enforce an obligation in terms of the Act, is guilty of an offence.

“It is clear that Cllr Bobani is interfering in administrative disciplinary processes that are still pending before disciplinary tribunals. Some of the officials that face disciplinary charges, date from his tenure as Deputy Mayor and Member of the Mayoral Committee (MMC) of Public Health,” he added.

“It appears that Cllr Bobani and the ANC, EFF, UF and AIC   ruling Coalition are protecting corrupt officials by ensuring that their cases are withdrawn and that they return to work in order to continue to loot the public’s purse.

“This is the third Acting Municipal Manager to be appointed in the past three months.  

“One has to wonder why Acting Municipal Managers resign after such a short period. It can only be that the ruling coalition are illegally interfering in the administration by putting undue pressure on the Acting City Managers.”

'ACDP will not allow UDM, EFF, ANC, AIC and UF to steal from the poor'

Grootboom said that the ACDP will not sit and fold hands and allow the United Democratic Movement (UDM), the Economic Freedom Fighters (EFF), the African National Congress (ANC), the African Independent Congress (AIC) and the United Front (UF) “ continue destroying our city and allowing them to reinstate some officials that have been linked to corruption”.  

“These matters will be reported to National Treasury so they can investigate this conduct. The lifting of suspensions on certain officials could jeopardise current, ongoing forensic investigations and matters which are currently being heard in the courts,” he added.    

“It is clear that Cllr Bobani and the EFF, ANC, AIC and UF coalition are not interested in serving the residents of the metro.

“Their intentions are to loot and to steal from the poor; the very people, who need services the most, and this will not happen on the ACDP’s watch.”
