DA says 'illegal' Great Kei Mayor to be removed after it protested to CoGTA

The objection by the Democratic Alliance (DA) to the appointment of Ngenisile Thekile as the Mayor/Speaker of the Great Kei Local Municipality has been vindicated, the party said on Tuesday.

"This, after confirmation was received that he will be removed," said Bev Wood a DA Councillor and Whip in the Great Kei Local Municipality

According to Wood, on 31 July 2018, during an "illegal" council meeting, the African National Congress (ANC) defied the Independent Electoral Commission to install Thekile as the new Mayor/Speaker.

"The ANC forced Thekile’s predecessor, Loyiso Tshetsha, to resign. Cllr Tshetsha tended his resignation as Mayor/Speaker but did not resign as a councillor. Accordingly the Electoral Commission of South Africa (IEC) refused to declare a vacancy in council," she described.

"Thekile is a former Mayor /Speaker and on his watch allegations of corruption was rife.

"The induction of Thekile was illegal as there was no vacancy in Council, and he could not have been sworn in as a councillor. Furthermore, his election as mayor would have been illegal as there was no quorum in the council chamber for the election to take place."

Wood added that the council is made up of 13 councillors, which requires a quorum of 50% plus 1 to be considered to quorate.

"Only five councillors were present at the meeting and any business conducted must be declared null and void.

"The DA took this matter up with the office of Fikile Xasa, MEC for Cooperative Governance and Traditional Affairs (COGTA)," she said.

"We have now been informed by the administrator of the municipality, that this council meeting will be nullified. This nullification will take place at a special council meeting scheduled for Friday, 17 August 2018.

"The DA caucus will always fight for the rule of law to be followed and will not permit residents’ rights to be compromised by the ANC."
