When must annual leave be taken

Annual leave normally accrues at 1.25 days per month.  As soon as an employee has accumulated leave he or she is entitled to take such leave consecutively and the employer may not unreasonably refuse such leave. 

The employee and employer may however contract that the leave is to be taken at a specific time, i.e during the annual shut down period. 

Annual leave not taken during an annual leave cycle is automatically carried over to the next annual leave cycle, unless there exists an agreement to the contrary.

Based on the provisions of leave, it is essential that the contract of employment clearly set out the stipulations concerning leave and the manner in which same may be taken and accumulated.
